TERMS AND CONDITIONS OF THE NEEX ONLINE STORE

1. General Provisions

1.1. These Terms and Conditions set out the rules for using the NEEX online store, available at https://neex.shop (hereinafter referred to as the “Website”), as well as the rules governing the placing and fulfilment of orders.

1.2. The Seller is NEEX COSMETICS Iryna Boyko, registered in accordance with the laws of the Republic of Poland, with its address at: ul. Fabryczna 32/49, 05-500 Piaseczno, Poland, NIP: 7011311894, e-mail: neexcosmeticsoffice@gmail.com, telephone: +48519495385 (hereinafter referred to as the “Seller”).

1.3. NEEX sells professional nail-service products to individuals and legal entities within the delivery territory available on the Website.

1.4. Contracts concluded with Consumers are subject to the provisions of Polish and European Union consumer protection law. B2B contracts are governed by provisions applicable to relationships between businesses, taking into account any rights that may be granted to sole traders under applicable law.

2. Products and Prices

2.1. Information about the products, including their names, main characteristics, volume, quantity and prices, is available on the Website.

2.2. Prices are stated in the currency indicated on the Website and include applicable taxes unless expressly stated otherwise.

2.3. The Seller reserves the right to change prices and sales terms. Such changes shall not affect orders placed before the changes take effect.

3. Placing an Order

3.1. Orders are placed through the functionality available on the Website.

3.2. When placing an order, the Customer provides the information necessary for its fulfilment and delivery.

3.3. Before placing an order, the Customer is shown information concerning the product, its main characteristics, quantity, total price including applicable taxes, delivery costs and any other mandatory charges, where applicable.

3.4. Clicking a button clearly indicating an obligation to make a payment constitutes confirmation of the order by the Customer.

3.5. Upon receiving an order, the Seller sends an order confirmation to the e-mail address provided by the Customer.

3.6. Confirmation of the conclusion of the contract and its main terms are provided to the Customer on a durable medium, including by e-mail.

3.7. If fulfilment of an order is not possible, the Seller shall inform the Customer and refund any payments already made.

4. Payment

4.1. Available payment methods are indicated on the Website during the ordering process.

4.2. Payment may be made by bank card or by other payment methods available on the Website.

4.3. For B2B orders, payment may be made on the basis of an invoice or under other individually agreed terms.

5. Delivery

5.1. Available delivery methods, delivery areas, delivery times and costs are specified on the Website during the order placement process.

Orders are processed and handed over to the carrier from Monday to Friday. Orders placed before 15:00 are, where possible, handed over to the carrier on the same day. Orders placed after 15:00 are handed over to the carrier on the next business day.

5.2. Delivery is carried out through the carriers available on the Website.

5.3. Delivery costs are borne by the Customer unless otherwise stated during the ordering process or as part of a promotional offer.

6. Consumer’s Right of Withdrawal

6.1. A consumer who has entered into a distance contract has the right to withdraw from the contract within 14 calendar days without giving any reason, in accordance with the Act of 30 May 2014 on Consumer Rights (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta).

6.2. In the case of a sales contract concerning a single product, the withdrawal period begins on the day the Consumer or a person designated by the Consumer receives the product.

6.3. If an order consists of several products delivered separately, the withdrawal period begins on the day the Consumer receives the last product, lot or part of the order.

6.4. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision before the expiry of the applicable withdrawal period.

6.5. The Consumer may use the withdrawal form available on the Website or submit an unequivocal statement in another form.

6.6. In the event of withdrawal from the contract, the Seller shall refund all payments received from the Consumer, including the cost of the least expensive standard delivery method available.

6.7. The Seller shall make the refund within 14 days from the date on which the Seller receives the Consumer’s notice of withdrawal. The Seller may withhold the refund until the returned product has been received or the Consumer has provided proof of sending it back, whichever occurs first.

6.8. The Consumer must return the product no later than 14 days from the date on which the Seller was informed of the withdrawal. The direct cost of returning the product shall be borne by the Consumer unless otherwise provided by law or the Seller has agreed to cover such costs.

6.9. The Consumer shall be liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

6.10. The right of withdrawal does not apply in cases provided for by law, including sealed products which, once opened, cannot be returned for reasons of health protection or hygiene.

7. Complaints

7.1. The Seller is responsible for the conformity of the product with the contract in accordance with applicable Polish law.

7.2. If the Customer receives a product that is not in conformity with the contract, the Customer may submit a complaint.

7.3. A complaint may be submitted by e-mail to neexcosmeticsoffice@gmail.com, including the order number and a description of the issue. Where possible, photographs of the product may be attached to the complaint.

7.4. Consumer complaints shall be handled within the time limits prescribed by applicable law.

7.5. If a Consumer’s complaint concerns the lack of conformity of the product with the contract, the costs associated with making the product available for repair or replacement shall be borne by the Seller in accordance with applicable law.

8. B2B Orders

8.1. In the case of B2B orders, the Customer is a person entering into a contract in connection with their business or professional activity.

8.2. Rights granted exclusively to Consumers do not apply to B2B orders, except where such rights are granted to businesses by applicable law.

8.3. For B2B orders, the parties may individually agree on prices, minimum order quantities, payment methods, delivery times and other commercial terms.

9. Personal Data

9.1. The rules governing the processing of personal data are set out in the separate Privacy Policy, available on the Website.

10. Amendments to the Terms and Conditions

10.1. The Seller may amend these Terms and Conditions in the event of changes in legislation, Website functionality, payment or delivery methods, or for other important reasons.

10.2. Amendments shall not affect rights acquired by Customers before the new version of the Terms and Conditions comes into effect.

10.3. The current version of the Terms and Conditions is always available on the Website.

10.4. No provision of these Terms and Conditions shall limit any rights of Consumers granted under mandatory provisions of applicable law.
